Bode and Grenier represents a wide variety of clients in complex business
litigation. The firm has extensive experience representing parties in "mass
action" litigation under the 1933 and 1934 Securities Act, including derivative
actions. In addition, the firm has represented parties in litigation against
various federal agencies such as the Department of Energy, the Department of
Transportation, the Department of the Interior, and the Department of Commerce
in matters involving the application of complex government regulations, including
government enforcement actions.
When handling complex commercial litigation cases, Bode and Grenier employs
computer document storage and retrieval capabilities as well as sophisticated
case management techniques. Bode and Grenier has represented clients in complex
litigation in New York, Delaware, Michigan, California, Washington (state),
Washington, D.C., Nevada, Oklahoma, Florida, and Colorado.
Bode and Grenier has litigated complex intellectual property cases in state
and federal courts at the trial and appellate levels, including the Supreme
Court of the United States. The firm recently engaged in complex multiparty
litigation in federal court in New York concerning the Commodity Exchange Act
and regulations and rulings issued by the Commodity Futures Trading Commission.
Also, Bode and Grenier won a $68 million judgment against the Department of
Energy. The judgment was affirmed on appeal.
The firm procured a federal court verdict holding that a portion of Internet
domain name registration fees was an unconstitutional tax, thereby effecting
a $188 million fee reduction.
Bode and Grenier won one of the first federal court decision holding that the
term "sudden and accidental" in a comprehensive general liability
insurance policy means "unexpected and unintended," thereby facilitating
an eight figure settlement payment by the insurance company.
