Bode and Grenier represents individuals and surviving families
in high-profile matters arising from wrongful death and severe
personal injury. These cases, argued in federal and state courts
across the country, include complex civil rights matters (under
42 USC § 1983) against governmental entities, authorities
and individuals; wrongful death civil actions against private entities
and state officials resulting from the transfer of a violent offender
from one state to another; and egregious personal injury matters.
In a number of cases in which governmental authorities or actors
were involved in causing injury or death, the firm advances federal
civil rights claims as well as state/local statutory and common
law claims. Our attorneys have substantial experience with the
interplay of federal and state law in federal and state courts,
and in navigating the complexities of federal civil rights litigation.

Bode and Grenier represents a wide variety of clients in complex
business litigation. The firm has extensive experience representing
parties in "mass action" litigation under the 1933 and
1934 Securities Act, including derivative actions. In addition,
the firm has represented parties in litigation against various
federal agencies such as the Department of Energy, the Department
of Transportation, the Department of the Interior, and the Department
of Commerce in matters involving the application of complex government
regulations, including government enforcement actions.
When handling complex commercial litigation cases, Bode and Grenier
employs computer document storage and retrieval capabilities as
well as sophisticated case management techniques. Bode and Grenier
has represented clients in complex litigation in New York, Delaware,
Michigan, California, Washington (state), Washington, D.C., Nevada,
Oklahoma, Florida, and Colorado.

Bode and Grenier represents petroleum marketers, independent refiners,
public utilities, ethanol manufacturers, importers, and large energy
users on a broad range of issues impacting their businesses. The
firm practices before the Department of Energy, the Department
of Commerce, the Federal Energy Regulatory Commission, the Federal
Trade Commission, and the Nuclear Regulatory Commission, among
other federal administrative agencies. Mr. Bode serves as General
Counsel and Executive Vice President to the Independent Terminal
Operators Association.
Bode and Grenier represents clients before the Environmental Protection
Agency, state environmental agencies, and in private party litigation.
Members of the firm are conversant with CERCLA, RCRA, the CAA,
CWA, LUST, and other statutory/regulatory environmental laws. The
firm has prepared comments for its clients on proposed rulemakings
by various government agencies, including the EPA. Mr. Bode has
served as General Counsel to the Environmental Business Association.
Bode and Grenier represents clients in suits against insurance
companies who have refused to provide coverage in response to claims.
The firm has litigated the interpretation of dozens of major clauses
in comprehensive general liability policies. The firm won one of
the first decisions holding that the term "sudden and accidental" in
a CGL policy did not preclude coverage for environmental damages
incurred over decades. The federal court affirmed the position
we advocated that the clause meant only that the environmental
damage was "unexpected and unintended."
Bode and Grenier has represented and advised clients in diverse
areas including those involving patent protection, licensing agreements,
trade secrets, trademarks, and copyrights. The firm has successfully
enforced non-compete and non-disclosure agreements for employers.
In addition, Bode and Grenier has helped make law on the application
of the Lanham Act and WIPO decisions.
Bode and Grenier won a federal court judgment declaring that the
Intellectual Infrastructure Fund fee charged to Internet domain
name registrants was an unconstitutional tax. The firm has negotiated
disputes between ISPs and Internet domain name registrants. In
addition, the firm has represented a number of Internet domain
name registrants in federal litigation concerning trademark infringement,
federal Trademark Dilution Act claims, and the Anticybersquatting
Consumer Protection Act. The firm has prepared comments for clients
for submission to Congressional Committees, ICANN, and the Department
of Commerce on Internet governance issues.
Bode and Grenier represents major property owners in a broad array
of real estate matters encompassing easements, quieting title,
private and public nuisance suits, tenant disputes, and foreclosures.
The firm represents numerous homeowners in Virginia, North Carolina,
New Jersey and other locales in litigation arising from the installation
of "synthetic stucco." In the first such suit to go to
trial in Virginia, Bode and Grenier won a jury verdict against
a nationwide homebuilder in excess of $1.4 million. The jury finding
that that the builder acted fraudulently prompted the builder to
settle on favorable terms with two dozen other homeowners represented
by the firm.
In addition, Bode and Grenier has collected millions of dollars
on behalf of numerous individuals suffering from toxic mold exposure
due to faulty new home construction.
